Changes affecting Small Business in 2025

From January 1, 2025 there are a few changes coming into effect that could impact your business. Such as underpayment of wages will now be a criminal offence, expansions on plastics ban, disconnect laws, reforms to tax and BAS agent obligations, tax administration, superannuation and reporting obligations, changes to land tax thresholds and more.

Food Safety Update

Did you know that Food Safety Supervisors (FSS) are now required in nearly all food businesses? Each business should have an FSS reasonably available to supervise at all times and should display the certificate inside the business. In many cases, it will be necessary to have more than one person trained. Make sure your certificate is provided in the above format.

Data After Dark September Quarter 2024 Update

Earlier this month the NSW Office of the 24-hour Economy Commissioner released their quarterly Data after Dark report which showed the Hawkesbury's night-time spending grew by 9.4%.

Have your say on the functions and operations of Australian Small Business and Family Enterprise Ombudsman

The Australian Small Business and Family Enterprise Ombudsman (ASBFEO) was established in 2016 to advocate for, and give assistance to, small business and family enterprises. This includes assistance with disputes. The independent review considers whether the ASBFEO’s functions and operations are effective, and further feedback is being sought through a survey.

The survey will help the Independent Reviewer to ensure the ASBFEO is meeting the needs of the small business community. Small businesses, family enterprises, the franchising sector and their representatives are invited to provide feedback through the survey. The survey closes on 31 March 2025.

ANZAC Day Trading Rules

The Small Business Commissioner recently announced  changes to the operating restrictions for certain businesses on ANZAC Day. It is critical for businesses to understand the operational rules and employee entitlements as there has been a significant update to premises that are used wholly or predominantly for the retail sale of goods. Non-exempt retail shops are no longer allowed to open after 1pm and some businesses previously able to open will now no longer be able to trade.

Workers' compensation reforms to impact business

The NSW Government’s proposed changes to workers' compensation have significant implications for small and medium businesses. These reforms aim to streamline the system, reduce costs, and make the process clearer and more efficient, introducing new rules that employers will need to follow.

2025 - 2026 Federal Budget

The Australian Government’s 2025–26 Federal Budget includes a series of measures that assist small businesses amid persistent cost-of-living pressures, economic uncertainty and tight labour market conditions.

Among the Budget initiatives are:

  • Extending energy bill relief – around one million eligible small businesses will receive up to $150 off their bills until the end of 2025, bringing total energy bill relief up to $800 since 2022-23.
  • Buy Australian – the Government has committed to a $20 million “Buy Australian” campaign in 2025-26 to encourage Australians to buy locally-produced goods and services.
  • Mentoring for First Nations businesswomen – $3.4 million over three years to establish a placed-based business coaching and mentoring program for First Nations businesswomen and entrepreneurs.
  • Small business mental health and financial wellbeing – support for small business owners through the NewAccess for Small Business Owners program and Small Business Debt Helpline.
  • Disaster-affected businesses – $693.2 million in co-funding with states to support small businesses and not-for-profits affected by disasters.
  • Energy efficiency grants – assisting businesses with grants of up to $25,000 to manage their energy use and costs and improve their energy efficiency.
  • Extending protections for small businesses – extending Unfair Trading Practice and Unfair Contract Terms protections for small businesses.

Industry-specific initiatives include:

  • Apprenticeships – a doubling of the current maximum incentive payments for eligible housing construction apprentices from $5,000 to $10,000, aimed at assisting builders and other construction industry firms.
  • Contractor payment times – 20-day payment times for contractors and subcontractors in the construction industry for work completed for Government Business Enterprises undertaking major construction activity.
  • Draught beer excise – pausing indexation on draught beer excise by increasing support available under the existing Excise remission scheme for manufacturers of alcoholic beverages and Wine Equalisation Tax Producer rebate.
  • Fresh produce suppliers – $2.9 million to help suppliers understand and enforce their rights under the Food and Grocery Code of Conduct.
  • Franchising Code of Conduct – $7.1 million over two years for the ACCC to strengthen enforcement of the Franchising Code of Conduct, ensuring more transparent and effective regulatory framework.

Small Business Commissioners Annual Report

Earlier this month the Small Business Commissioner released its 2024 Annual Report outlining the activities and services delivered throughout the past year.

During 2024, the Commission saw a dramatic rise in the number of enquiries relating to digital platforms and services. Over the course of the year, the Commission worked to support better outcomes for small businesses that rely on digital platforms to conduct their business. The Commission launched the Digital Platforms Hub which helps businesses navigate common challenges, and continued its advocacy to support better outcomes for small businesses.

Current Grant Opportunities

EV fleets incentive kick-start funding for small organisations to transition to electric vehicles
This is a new fixed incentive funding option part of the EV fleets incentive designed to support small organisations or those in the early stage of their fleet transition to test Battery Electric Vehicles (BEVs) and charging infrastructure. This grant closes 30 June 2025, 5pm. Learn more and apply here.
Heritage emergency works grant for repairs to NSW heritage sites

This grant provides assistance to declared Aboriginal places and items on the State Heritage Register that need repairs due to, or to address risks caused by, unexpected events. Up to $10,000 is available to owners, managers, long-term lessees or custodians of a declared Aboriginal place or item listed on the State Heritage Register in NSW. EV site host EOI 2024-2025

The NSW Government is co-funding an EV charging network. We seek landowners and leaseholders interested in hosting stations, to share a list of potential sites to developers (Charge Point Operators). This application closes 31 December 2025 at 5pm. Learn more and apply here.
